If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

RexZ Cloud provides cloud hosting services including but not limited to:

Discord bot hosting and management
Virtual Private Server (VPS) hosting
Database hosting and management
Lavalink hosting for music bots
Game server hosting
API services and management tools

We reserve the right to modify, suspend, or discontinue any part of our Services with reasonable notice to users.

3. Account Registration and Security

Account Creation

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

Account Security

You must notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with these security obligations.

Age Requirements

You must be at least 13 years old to use our Services. If you are between 13 and 18 years old, you must have parental consent to use our Services.

4. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

For any illegal activities or to violate any applicable laws
To transmit spam, malware, or other harmful content
To infringe on intellectual property rights
To engage in cryptocurrency mining without prior approval
To attempt to gain unauthorized access to our systems
To overload our infrastructure or engage in DDoS attacks

5. Payment Terms and Billing

Payment Processing

All payments are processed through secure third-party payment processors. By providing payment information, you authorize us to charge the applicable fees.

Billing Cycles

Services are billed in advance on a monthly or annual basis, depending on your selected plan. Charges are non-refundable except as provided in our refund policy.

Late Payments

If payment is not received by the due date, your services may be suspended. We may charge late fees for overdue accounts. Services will be terminated if payment remains outstanding for more than 30 days.

Refund Policy

We offer a 7-day money-back guarantee for new customers. Refunds are processed to the original payment method within 5-10 business days.

6. Service Level Agreement

Uptime Guarantee

We guarantee 99.9% uptime for our services, excluding scheduled maintenance. If we fail to meet this guarantee, you may be eligible for service credits.

Maintenance Windows

We may perform scheduled maintenance with at least 24 hours notice. Emergency maintenance may be performed without prior notice when necessary for security or stability.

Support Response Times

We aim to respond to support requests within 2 hours for critical issues and 24 hours for general inquiries. Premium support customers receive priority assistance.

7. Data and Privacy

Data Ownership

You retain ownership of all data you upload to our Services. We do not claim any ownership rights to your content.

Data Security

We implement industry-standard security measures to protect your data. However, no system is completely secure, and you acknowledge the inherent risks of internet-based services.

Data Backup

While we perform regular backups, you are responsible for maintaining your own backups of critical data. We are not liable for data loss.

8. Limitation of Liability

To the maximum extent permitted by law, RexZ Development shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for any claims arising from or related to these Terms or our Services shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

Termination by You

You may terminate your account at any time through your account dashboard. Termination will be effective at the end of your current billing period.

Termination by Us

We may terminate or suspend your account immediately if you violate these Terms, engage in prohibited activities, or fail to pay fees when due.

Effect of Termination

Upon termination, your access to the Services will cease, and we may delete your data after a reasonable period. You remain liable for all charges incurred prior to termination.

10. Changes to Terms

We may modify these Terms at any time by posting the updated Terms on our website. We will notify you of material changes via email or through our Services. Your continued use of our Services after the effective date constitutes acceptance of the modified Terms.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where RexZ Development is incorporated. Any disputes arising from these Terms or our Services shall be resolved through binding arbitration or in the courts of competent jurisdiction.
